“Presunción de remuneratividad”

Abstract

This paper is a brief resume of a larger work, wich consist on a thesis elaborated to obtein the Master´s degree on State Attorney of the Universidad de Tres de Febrero with the Escuela del Cuerpo de Abogados y Abogadas del Estado within the Procuración del Tesoro de la Nación.

Here, I carried out a systematization around the way in which the Supreme Court of Justice of the Nation has been evaluating the legal nature of the allegedly non-remunerative sums. From this, a hermeneutical proposal is offered, wich I call "presumption of remuneration" to resolve disputes of this type.
