Abstract

The Necessity and Urgency Decree No. 690/2020, which established that Information and Communications Technology (ICT) Services and access to telecommunications networks for and between licensees and licensees of ICT services are essential and strategic public services in competition constitutes a measure of reestablishment of powers of the State present in Law 27.078 Argentina Digital. Considering connectivity as a right, the measure responds to international and inter-American human rights standards and, in particular, the human right to communication. The objective is to provide background, systematize scattered information, and provide documentary inputs on the nature of the ICT public service, the human right to connectivity and the need for a regulatory State that carries out inter-ministerial and inter-sectorial public policies that guarantee the rights of users in a universal way, address social inequalities and at the same time promotes investments and development of the sector with social responsibility.
