Abstract

The idea that prevails today is the restriction on individual rights in pursuit of safeguarding common goods, such as the environment and it is an unavoidable truth. Nevertheless, the analysis of the reasonableness or of the proportionality of such a measure cannot be set aside in a constitutional state of law. In doing this job, the study of the environmental principles acquires a leading role when integrating, interpreting, applying and/or arguing about the right.
