Abstract

“Legal interpretation takes place in a field of pain and death”, Robert Cover tells us in his classic text “Violence and the Word”, a drastic definition that helps us think –and perhaps undress the way in which we naturalize the power of confinement and suffering that nests in criminal punishment. The Artigué case is analyzed here. It is here the proper name of a disposable life, stripped of rights, naked life, which evokes surplus multitudes in its suffering. Subject to punishment by factual powers without law, homo sacer of a state of exception that becomes the rule, triumph of barbarism over the law, as indicated by the experience of confinement in the region according to the copious doctrine of the Inter-American Court.
