Abstract

The Organization for Economic Cooperation and Development (OECD) monitors the advances of Artificial Intelligence worldwide through its Artificial Intelligence (AI) Policy Observatory. Within the framework of his studies on public governance, he has prepared, together with the Development Bank of Latin America (CAF), the report entitled "Strategic and responsible use of artificial intelligence in the public sector of Latin America and the Caribbean", in the which highlights Uruguay as the only country in Latin America and the Caribbean that has a specific strategy for restructuring the public sector through AI (OECD/CAF, 2022). This article intends to analyze the Uruguayan artificial intelligence strategy in the national regulatory context, particularly Law No. 18.381, of October 17, 2008, on access to public information and No.18.331, of August 11, 2008, on the protection of personal data. This, in order to determine if its practical application is possible in terms of active and passive transparency and the right of people to know the processes used in decision-making by public bodies, while the strategy proposes the double role of the State which must, at the same time, be accountable and control algorithmic processes, at least public ones.
